Decision

Craig J. J. Snyder moves by order to show cause to withdraw as attorney for the claimant, Wendell Evans. Claimant's counsel was suspended from the practice of law in the State of New York by order of the Appellate Division, First Department, filed January 14, 2010. Claimant was served with the order to show cause and supporting papers by both regular mail and certified mail, return receipt requested, as directed in the order. No opposition to the motion having been filed, it is hereby

ORDERED, that the motion of Craig J. J. Snyder to withdraw as counsel for claimant is granted subject to compliance with the service and filing requirements hereinafter set forth, and it is further

ORDERED, that within fifteen (15) days of the filing of this Decision and Order, withdrawing counsel shall serve a file stamped copy upon claimant by regular mail and by certified mail, return receipt requested, at claimant's last known address, and upon the defendant by regular mail, and shall file an affidavit of such service with the Clerk of the Court; and it is further

ORDERED, that within fifteen (15) days of the filing of this Decision and Order, withdrawing counsel shall provide claimant with a copy of his file by certified mail, return receipt requested, at claimant's last known address, and shall file an affidavit of compliance with the Clerk of the Court of Claims; and it is further

ORDERED, that all proceedings herein are stayed for forty-five (45) days from the filing of this Decision and Order within which time claimant shall secure new counsel who shall file a Notice of Appearance with the Clerk of the Court or claimant shall notify the Clerk of the Court (New York State Court of Claims, P.O. Box 7344, Capitol Station, Albany, NY 12224) and the Office of the Attorney General in writing of his intention to proceed without counsel (pro se).
