Decision

Claimant makes a motion for a Subpoena Duces Tecum on a non-party, specifically the

New York City Department of Correctional Services. Claimant served Defendant with a copy of this motion . Claimant also served both the New York City Department of corrections and the City of New York Law Department on June 16, 2009.

No opposition to Claimant’s motion has been filed with the Clerk of the Court. Accordingly, the Court shall grant Claimant’s motion. A copy of the signed subpoena provided by Claimant with the motion is attached to this Decision and Order. The original subpoena is being sent to Claimant’s counsel under separate cover.
