Decision

The following papers were reviewed by the Court on this motion: Claimant’s Notice of Motion, Claimant’s Affidavit in Support with annexed documents and Defendant’s Affirmation in Opposition. Claimant, Jean D. Baptichon, a pro se litigant, has brought this motion pursuant to Civil Practice Law and Rules (CPLR) 3215 seeking an order granting default judgment against defendant, the State of New York, in this matter.

However, given this Court’s previous Decision and Order, filed July 13, 2007 dismissing the claim in its entirety, the Court finds the present application to be moot (see also 22 NYCRR § 206.7).

Therefore, for the foregoing reasons, claimant’s motion seeking a default judgment is denied.
