Decision

The following papers were reviewed by the Court on this motion: Claimant’s “Unanswer Motion for Discovery and Inspection” with Annexed Exhibits, Defendant’s Affirmation in Opposition with Annexed Exhibits A-C.

Claimant, John Matias, a pro se inmate, moves this Court for an order compelling defendant to comply with the Notice for Discovery and Inspection that was served on June 28, 2006. Defendant filed a reply to claimant’s Notice for Discovery and Inspection on May 16, 2007.

Given that defendant has responded, albeit belatedly, and there is no prejudice to claimant due to the lateness of the reply, this motion is denied as moot.
