This motion addresses a subpoena duces tecum issued by the Defendant seeking production of a certain videotape and other documents prefatory to a witness examination held pursuant to open commission in the Republic of Trinidad and Tobago. [See Affirmation by Gregory Cannata, Counsel for Claimants, Exhibit 1]. Based upon the Assistant Attorney General's withdrawal of the subpoena, the present motion is denied as moot. [Affirmation by J. Gardner Ryan, Assistant Attorney General, ¶5].
