Decision

Defendant made an oral motion during the trial of this matter to dismiss all Defendants

named as parties other than the State of New York on jurisdictional grounds and to dismiss the individual claim of Andrew Charles Blanchard.

Claimant having no opposition to the motion, the Court granted Defendant's request on the trial record on December 6, 2005,

Accordingly, the motion is GRANTED and the caption is amended to reflect the State of New York as the only proper Defendant and the individual claim of Andrew Charles Blanchard is DISMISSED, as reflected in the caption of the Order.
