Decision

The court read and considered the following papers on claimant's motion for an order striking the answer due to defendant's failure to provide disclosure: Notice of Motion, Affirmation and Exhibits, Affirmation in Opposition and Exhibits; Reply Affirmation and Exhibits.

The issues raised in this motion were discussed and resolved at a conference on February 25, 2005. A deposition of a former CUNY employee will be held no later than April 1, 2005 and claimant will file a note of issue by May 1, 2005. The motion is denied as moot.
