Decision

A motion seeking permission to be relieved from further representation of Claimant

pursuant to CPLR 321(b)(2) by the Proskin Law Firm by Order to Show Cause is before this Court. On January 12, 2005, a hearing on the Order to Show Cause was held and Arnold W. Proskin, Esquire, personally appeared in support of the Order to Show Cause. G. Lawrence Dillon, Assistant Attorney General for the State of New York was also present. The Court received a letter from Claimant on December 14, 2004, which was also considered on the motion. On the return date, the Court gave Mr. Proskin an opportunity to speak with Claimant and advise the Court by January 24, 2005, of the law firm's position.

Now, after reviewing the documentary submissions and hearing from Mr. Proskin, it is hereby

ORDERED that the motion is DENIED.
