After carefully reviewing the papers issued and the applicable law the Order to Show Cause is resolved as follows:

The Court is satisfied that Claimant was duly served with a copy of the Order to Show Cause issued by the Court on August 18, 2004. Additionally, a duplicate claim under Claim Number 108923 has been served and filed that appears to comply with Court of Claims Act §11(b).

Claimant has failed to establish why the within claim should not be dismissed for a lack of jurisdiction and a failure to comply with the verification requirements of Court of Claims Act §11(b) and, accordingly, Claim Number 108757 is hereby dismissed in its entirety.
