Decision

The following papers numbered 1 to 5 were read and considered on Claimant's motion

for permission to late file a bill of particulars demanded by the Defendant:

1,2 Notice of Motion, Motion for Permission to File a Late Bill of Particulars and attached exhibits

  1. Affirmation by Jeane L. Strickland Smith, Assistant Attorney General
4,5 Filed papers: Claim, Answer

The Assistant Attorney General indicates that the Defendant has no objection to Claimant's late filing of his bill of particulars and requests only that same be verified as requested in the verified demand.

Accordingly, Claimant's motion number M-68417 is hereby granted on consent, and Claimant is directed to serve a verified bill of particulars upon the Defendant. Since this is a document that is served on another party, Claimant is reminded of the requirement that he file a copy of the verified bill of particulars in the Office of the Chief Clerk of the Court of Claims, along with proof of service of the bill upon the Defendant, as required by 22 NYCRR §206.5(c).
