This claim was scheduled for trial at Sing Sing Correctional Facility on December 15, 2003. On December 8, 2003, claimant filed a discovery motion with the Court (Motion No. M-67747).

At the trial, Assistant Attorney General Elyse Angelico represented that claimant's motion was not in her file and claimant conceded that some of the items sought in his motion had been turned over to him. The trial was adjourned without date and the Court directed claimant to submit a motion returnable January 21, 2004 regarding any outstanding discovery.
