Decision


Claimant has moved for permission to late file a claim. Although the notice of motion andsupporting affidavit are accompanied by an affidavit of service, the affidavit attest to service of a claim form, an affidavit in support of an application for poor person status and an authorization form. Inasmuch as there is no proof of service of the notice of motion and affidavit in support of the application for leave to late file, and as there is no response to the motion from defendant, the motion is denied without prejudice.
