Decision
Claimant seeks damages for property that was allegedly lost by defendant on June 8, 2000 when claimant was transferred from Sing Sing Correctional Facility to Upstate Correctional Facility. This claim was heard in a unified trial.
Claimant testified that he lost trial transcripts, 16 canvas boards, cosmetics, a bible, personal photographs and letters. He contends that he filed and appealed a grievance. No documentary evidence was offered and there was no testimony as to the alleged value of the articles. Accordingly, claimant has failed to meet his burden of proof and the claim warrants dismissal.
