Decision

Claimant has brought this motion seeking an order compelling the defendant to respond to claimant's previously served interrogatories, and to produce the documents requested therein.

The following papers were considered by the Court in connection with this motion:
Notice of Motion, Affidavit in Support 1,2

Affirmation, with Exhibits A-G 3

In his response to this motion, the Assistant Attorney General handling this claim for the defendant has submitted a "Response to Interrogatories" (see Item 3, Exhibit G) and has also forwarded to claimant copies of his Ambulatory Health Record, Report of Operation (3-18-99) Crouse Hospital, and University Hospital medical records (see Item 3, Exhibit F).

It therefore appears that defendant has provided an adequate response to the demands served by claimant.

Accordingly, it is

ORDERED, that Motion No. M-65645 is hereby DENIED as moot.
