Decision

Claimant has moved to reargue a decision of the court dismissing the claim on the basis that

it was not served in the manner required by Court of Claims Act §11 (Pelzer v State of New York, Motion No. M-61066, April 12, 2000, McNamara, J.). The court previously denied a motion by claimant to reargue the same decision and order (Pelzer v State of New York, Motion No. M-61721, August 21, 2000, McNamara, J.) and therefore, based upon the doctrine of law the court will not consider this or any further applications to reargue the decision dismissing the claim.
