Claimant seeks an order precluding defendant from offering any evidence at trial as to defendant's affirmative defenses which were the subject of claimant's Demand for a Bill of Particulars to which defendant did not serve a response.

In opposition to claimant's motion, defendant has served a response to claimant's demand and has withdrawn defendant's first and second affirmative defenses.

Accordingly, claimant's motion is DENIED as moot.
