Decision



James Reed, Claimant, alleges that on or about October 6, 1996, while he was


outside of his cell and in the yard of Green Haven Correctional Facility his cell was set afire.

This fire occurred while the tier was scheduled to be vacated by inmates. An investigation by

the Department of Correctional Services personnel determined that the fire was an act of arson.

Claimant established to the Court's satisfaction the value of his property.That evidence and

proof was not refuted by the Defendant. The Court found the Claimant credible. The motion by

the Defendant to dismiss the Claim was denied. Due deliberation having been had, it is



ORDERED that the Court finds for the Claimant in the amount of Six Hundred


Dollars ( $600.00) with interest from October 6, 1996 to April 6, 1997, and from October 5,

1998 to the date of Decision and thereafter to entry of Judgment. The Clerk of the Court is

hereby directed to enter said Judgment accordingly.
