Decision


Hobie Townsend, Claimant, alleges that on or about June 2, 1997 certain


personal property was broken, lost or otherwise damaged and made unusable by Department of

Correctional Services personnel. A trial was held on this matter on May 18, 2000. The Claimant

to the Court's satisfaction, placed in evidence proof of the value of the items in question. The

Claimant was credible. The Defendant did not sufficiently refute the allegations of the Claimant.

At the conclusion of the trial, a bench decision was rendered on the record on behalf of the

Claimant. Due deliberation having been had, it is




ORDERED that the Court finds for the Claimant in the amount of


Four Hundred Dollars ($400.00) with interest from June 2, 1997 to December 2, 1997, and from

June 8, 1998 to the date of Decision and thereafter to entry of Judgment; the Clerk of the Court is

hereby directed to enter said Judgment accordingly.
